Perkins v Peacehealth, April 5, 2004
After a week of trial in Eugene, Oregon, where the defendant, Peacehealth, owns the local hospital, a jury of Lane County citizens unanimously found Peacehealth negligent in causing the death of a 65 year old professional musician, Duane Perkins. The verdict of nearly $645,000 was for the full amount of damages sought by the plaintiff, Sally Perkins, who was represented by Dave Miller of Miller & Wagner.
The verdict received front page coverage in the local Eugene, Oregon paper, The Register Guard, which summarized the facts of the case and highlighted the fact the verdict came after only 45 minutes of jury deliberations. Perkins received inadequate care and why that care caused Mr. Perkins to die prematurely. The unanimous verdict clearly is a reflection of the quality of the testimony offered by Mr. Miller.
