Oregon Ballot Measure 35 - DEFEATED on November 2nd, 2004!!!
The effort of the insurance industry and the medical profession to put a cap on non-economic damages has once again failed to convince Oregon voters. Measure 35, which would have amended the constitution to put a cap of $500,000 on non-economic damage awards in medical malpractice cases, went down to defeat in the general election last week despite a $6 million dollar sales effort on the part of oregon hospitals, physician organizations and others advocating so-called "tort reform."
Many thanks to our clients and friends who opposed this measure. The propoganda spread during the campaign left many confused about the intent and purpose of the measure. Fortunately, a majority of Oregon voters took time to read the measure and learn the impact it would have had upon Oregon citizens and our valued jury system.
The defeat of this measure will not deter those who seek to limit peoples' rights; efforts are going to continue in congress and elsewhere. we believe there are genuine issues--not artificially capping damages--which should be debated further, such as why insurers are charging some physicians exorbitant rates for their insurance. We intend to continue working to try and find solutions which fix problems without sacrificing peoples' rights. We believe there are things that can and should change, but for the better.
